GENERAL TERMS AND CONDITIONS OF THE WEBSITE

1.- Scope of Application

Servitec Solutions, S.L., is a commercial company founded in 1993. Registration data in the Commercial Registry: Servitec Solutions, a limited liability company incorporated in Barcelona in 1993, registered in the Commercial Registry of Barcelona, Volume 26545, Folio 225, Sheet No. B-105750, Entry 8, Tax ID (CIF): B60419520. Its corporate purpose is the purchase and sale of textile machinery, as well as the corresponding software and technical service, research and development of CAD-CAM systems, their implementation, commercialization, etc.

Servitec Solutions, S.L. is the owner of the internet domain audaces360.com. These General Terms and Conditions are intended to regulate the contractual and sales conditions of its products. These conditions are at all times subject to Spanish law and EU Directives regulating contracting conditions in retail sales transactions. Among others, the following shall apply:

  • Law 7/98 of April 13 on General Conditions of Contracting
  • Law 7/96 of January 15 on the Regulation of Retail Trade
  • Directive 2000/31 EC of the European Parliament
  • Law 34/2002 of July 11 on Information Society Services and Electronic Commerce
  • Law 3/2014 of March 27, amending the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of November 16, and other applicable laws and regulations.

Any other Spanish law, law amendment, or EU Directive not included in the above list that modifies the conditions of sales contracts and is therefore applicable to transactions carried out by Servitec Solutions with its customers will also apply.

Users who make purchases through Servitec Solutions declare that they know and accept these General Conditions without reservation or exception. In case of doubt regarding any of these General Conditions, the customer may consult our Sales Department at: comercial@servitec-solutions.com

Servitec Solutions may unilaterally and without prior notice modify any of the obligations set forth in these General Conditions, including prices in confirmed orders if due to typographical errors in the Online Store database or errors in the supplier’s database. In this case, we will offer the customer the option of a refund or replacement with other products of similar characteristics.

2.- Order Confirmation

    An order placed through our sales team is considered confirmed when the following four steps have been completed:

  • The customer has received the product information.
  • The customer accepts our general conditions and provides billing and delivery address details.
  • The customer accepts the payment terms offered. (See payment methods).
  • The customer makes the payment using the method selected.

3.- Prices

    Products subject to the levy under Article 25.21 of Royal Legislative Decree 1/1996 of April 12, approving the Consolidated Text of the Intellectual Property Law, include the levy in their sales price. Servitec Solutions unilaterally reserves the right to modify prices and availability of products at any time and without prior notice. This modification, except for typographical errors, does not affect confirmed orders placed before the change.

4.- Payment Methods

    When initiating the purchase process, the customer must provide the necessary billing and delivery details. Servitec Solutions offers two payment methods:

4.1.- Bank Transfer

    Once the user selects bank transfer as the payment method, they will instantly receive an email with the order details and the bank account numbers for the transfer. Customers are asked to indicate as reference “Order Payment No. xxxxx” to facilitate verification.

4.2.- PayPal

    PayPal is considered one of the most secure payment systems. It accepts VISA and MasterCard cards registered with PayPal. Once selected, our sales team will provide the PayPal account details directly to the customer. Data entered by the user is stored exclusively in PayPal’s system.

5.- Orders from International Customers

    For orders outside European territory, the customer must process the order directly through our Sales Department. Payment and order terms must also be arranged with them. Contact: comercial@servitec-solutions.com

6.- Availability and Delivery

    Our sales team will confirm availability of the selected product. The customer must return the signed and stamped document along with proof of payment. Sales terms are EXW (Ex Works). The order is shipped using a transport agency chosen by the customer, who bears transport costs. We provide weight and dimensions so the customer can inform their transport company. Products are packed securely. Before delivery to the transport agency, Servitec Solutions takes photos of the goods to prove they left our warehouse in perfect condition. Delivery times are 2–4 business days within mainland Spain.

If within 2 business days of confirmation the goods have not been collected by the customer’s transport agency, we will notify the customer immediately.

6.1.- Customer Obligations upon Receipt

    The transport agency delivers the order and requires signature on the delivery note. Signing implies acceptance without claims.

Before signing, the customer must:

  • Check the number of packages matches the order.
  • Verify packages are in perfect condition (no visible damage, original seals intact).

If anomalies are found, the customer must note them and immediately contact the transport agency’s Sales Department.

Even if no visible damage is detected, we recommend noting “Material pending inspection” on the delivery note to activate transport insurance coverage in case damage is later discovered.

7.- Returns and Withdrawal

    Returns and withdrawal are regulated by Royal Decree 1906/1999 of December 17 (electronic and telephone contracts) and Law 7/1998 of April 13 (General Conditions of Contracting).

Servitec Solutions reserves the right to claim compensation for damages or costs caused by the return.

Returns are accepted only if:

  • The material does not match the order. In this case, Servitec Solutions covers shipping and replacement costs. The customer must check the goods upon receipt and notify anomalies within 48 hours. Failure to notify releases Servitec Solutions of responsibility.
  • The returned material must be unused, unopened, in original packaging, and in perfect condition for resale.

If the customer received the correct order but wishes to return it, Servitec Solutions does not accept returns.

8.- Warranty Conditions for New Products

8.1.- All new products carry the manufacturer’s warranty as detailed in accompanying documents (generally one year from receipt).
8.2.- Warranty covers manufacturing defects and faulty parts, subject to verification.
8.3.- Refurbished Desktops: 1-year warranty (power supply excluded). Repairs require sending the product prepaid; return shipping covered once repaired.
8.4.- Refurbished Laptops: 1-year warranty (batteries and chargers excluded; batteries covered for 3 months with at least 1-hour autonomy). Same shipping terms apply.

9.- Warranty Exclusions

Warranty does not cover, and costs will be borne by the customer, in cases of:

  • Damage from negligence or misuse.
  • Damage from accidents, force majeure, weather, or disasters.
  • Incorrect installation or lack of maintenance.
  • Use of improper chemicals or residue buildup from poor cleaning.
  • Incorrect machine placement.
  • Normal wear and cosmetic damage.

Warranty covers only defective materials or non-consumable parts. Travel and transport costs are borne by the customer. Replacement parts are shipped at buyer’s risk and expense. Faulty parts must be returned for verification before reimbursement.

Warranty is void if products are damaged by shocks, incorrect voltage, liquids, improper environmental conditions, incorrect installation, tampering, or incompatible devices. For devices requiring software, warranty covers only hardware failures—not software issues.

Servitec Solutions will comply with Law 23/2003 of July 10 on guarantees in the Sale of Consumer Goods for unresolved claims.

10.- Product Information on Website

    Due to the complexity of maintaining and updating product information, the customer releases Servitec Solutions from responsibility regarding accuracy of product details.

11.- Intellectual Property Rights

    The copyright of all pages on www.audaces360.com belongs to Servitec Solutions, S.L. All rights reserved. Servitec Solutions may modify content, configuration, or access to the site at any time without prior notice.

Except for personal and private use, reproduction, copying, distribution, commercialization, public communication, or any other use of the website’s information without authorization is strictly prohibited.

12.- Applicable Law

    For disputes regarding interpretation or enforcement of these General Conditions by any private user, both parties submit to the Provincial Arbitration Board of Córdoba.
